Terms of Service

You must be at least 18 years old to use Cumomics. By using the service you confirm that you are.

Cumomics provides an at-home test that measures a sample and expresses the result as a proprietary index, the Cum Capacity Index (CCI), along with a website that shows your results, optional leaderboards, and optional correlations with data you connect. The service is provided for personal, informational, and entertainment purposes.

The CCI is not a medical or diagnostic measurement. Cumomics does not provide medical advice, and nothing in the service should be relied on for any health decision.

You are responsible for the activity on your account and for keeping your credentials secure. Provide accurate information and keep it current. We may suspend or terminate accounts that violate these terms.

You agree not to:

• submit samples or data that are not your own, or impersonate anyone;
• attempt to access other users' data, disrupt the service, or circumvent its security or rate limits;
• use the service for any unlawful purpose or in violation of any applicable law.

You may choose to connect third-party accounts (such as Oura). Your use of those services remains governed by their own terms and privacy policies. We access your data from them only with your authorization and only to provide features within Cumomics. You can disconnect at any time, and on disconnection we delete the data we obtained from that provider, including values derived from it, within 72 hours.

Those third-party providers give no warranties to you through Cumomics: all warranties on their behalf, express or implied — including merchantability, fitness for a particular purpose, and non-infringement — are disclaimed, and they are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of Cumomics or any connected service.

The service, including the CCI methodology, software, and branding, is owned by Cumomics. You retain ownership of the data you submit; you grant us the rights needed to operate and improve the service as described in our Privacy Policy.

The service is provided “as is” without warranties of any kind, express or implied. We do not warrant that results are accurate, complete, or fit for any particular purpose, or that the service will be uninterrupted or error-free.

To the fullest extent permitted by law, Cumomics will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or US $100.

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these terms or the service will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.
